CLIENT ALERT: FLSA Overtime Rule Changes Put on Hold for Now
On Tuesday, November 22, 2016, a Federal District Court in Texas issued a preliminary injunction preventing the Department of Labor’s new overtime regulations regarding executive, administrative and professional employees (“white-collar employees”) from taking effect on December 1, 2016. This Injunction is nationwide and takes effect immediately. As the Injunction is not a final order, it is subject to revision or appeal, and will remain in effect until further order of the District Court or the Court of Appeals.
Under the Injunction, employers are not required to comply with the new minimum salary threshold requirements for white-collar employees, which were increased to $913/week ($47,476 annually). Until further notice, the current minimum salary basis, as established by the current Department of Labor regulations, will continue to be $455/week ($23,660 annually). For Connecticut employers, however, the minimum salary basis will continue to be $475/week ($24,700).
